1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the wallet, staking, and financial features. You must be at least 13 to use other features. By using the Service, you represent that you meet these requirements and are not barred from using it under any applicable law.
2. Accounts & sign-in
You can create an account with an email and password or by using a third-party sign-in provider such as Google. We offer “Continue with Google” as an optional convenience: it lets you register and sign in quickly without creating a separate password, and it uses Google’s verification to help keep your account secure. When you use it, we rely on Google to authenticate you and to provide your basic profile (name, email, and picture) to set up your account; see our Privacy Policyfor details. You remain responsible for maintaining the confidentiality of your credentials — including your linked Google account — and for all activity under your account. Keep your information accurate, and notify us promptly of any unauthorized use.
3. The Service
Momentum is an AI-assisted running application that lets you track runs, follow personalized coaching plans, view analytics, chat with an AI coach, and stake and manage funds through an in-app digital wallet. We may add, change, or remove features at any time and may set limits on or restrict access to the Service without notice or liability.
4. Health & fitness disclaimer
Momentum is not a medical provider. Consult a physician before starting any exercise program. Coaching plans, run targets, and AI suggestions are for general informational and motivational purposes only and are not medical advice. You participate in physical activity at your own risk. Stop exercising and seek medical attention if you experience pain, dizziness, or discomfort.
5. Wallet, staking & digital assets
The Service includes an in-app digital wallet provisioned through a third-party wallet-infrastructure provider, which may let you deposit funds and stake on running goals or plans. You acknowledge and agree that:
- Digital assets and blockchain transactions carry risk, including the risk of total loss, price volatility, and network failures.
- Blockchain transactions are generally irreversible; once submitted, they cannot be cancelled or reversed by Momentum.
- You are responsible for the accuracy of any transaction you authorize, including amounts and destinations.
- Staking outcomes may depend on your completion of goals and other conditions described in-app; staked funds may be subject to loss under the applicable plan rules.
- Momentum does not provide financial, investment, tax, or legal advice.
- You are responsible for any taxes arising from your use of these features.
You must only use funds and assets that you own and are legally permitted to use, and you must comply with all applicable laws, including anti-money-laundering and sanctions requirements.
6. AI coach
The AI coach generates responses using automated systems and may be powered by third-party AI providers. Responses may be inaccurate, incomplete, or unsuitable for your situation. Do not rely on the AI coach for medical, financial, legal, or other professional decisions, and do not submit content you are not authorized to share.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Attempt to gain unauthorized access to the Service or interfere with its operation or security.
- Reverse engineer or attempt to extract source code, except as permitted by law.
- Upload malware or use bots or scrapers to access the Service without permission.
- Falsify activity, location, or run data, or manipulate staking outcomes.
- Infringe the intellectual property or privacy rights of others.
8. Intellectual property
The Service, including its software, design, text, graphics, and logos, is owned by Momentum or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You retain ownership of content you submit and grant us a license to use it as needed to operate and improve the Service.
9. Third-party services
The Service integrates third-party services, including sign-in providers, wallet infrastructure, AI providers, and mapping providers. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
10. Termination
You may stop using the Service and request account deletion at any time. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOMENTUM AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR DIGITAL ASSETS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.
13. Indemnification
You agree to indemnify and hold harmless Momentum and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
14. Governing law
These Terms are governed by the laws of your operating jurisdiction, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in that jurisdiction for any dispute not subject to arbitration, where permitted by applicable law.
15. Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
